Acceptance of Terms

Welcome to Hola Car Rentals, a service operated by Andaluz Group LLC, a Delaware limited liability company, doing business as Hola Car Rentals. These Terms and Conditions (“Terms”) govern your access to and use of the Hola Car Rentals website (the “Site”) and all reservations or services obtained through it. By accessing or using any part of this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in full. If you do not agree to any part of these Terms, you must discontinue use of the Site and services immediately. Use of the Site is expressly conditioned on your acceptance of these Terms.

Scope of Services (Third-Party Intermediary)

Hola Car Rentals operates as an online third-party car rental reservation platform. Our Site allows users to search for, compare, and reserve rental cars offered by various independent rental car companies (“Providers”). Hola Car Rentals is solely a booking agent/intermediary facilitating reservations and processing payments on behalf of these third-party Providers. We do not own, manage, or operate any rental vehicles, and we do not provide the actual car rental services directly. All car rental offers displayed on our Site are supplied by the Providers, and the responsibility for fulfilling your car rental booking (providing the vehicle and related services) rests entirely with the selected third-party rental company.

Hola Car Rentals operates as a broker for third-party services and assumes no liability for the actions, omissions, or negligence of those third-party Providers, including any failure by a Provider to deliver services. Our role and responsibility are limited to handling your reservation details, securely processing your payment, and providing customer support for booking-related issues. Beyond that, we are not responsible for the actual rental transaction or the condition of the vehicle, which are under the control of the Provider.

Third-Party Car Rental Providers and Rental Agreements

When you book a rental car through Hola Car Rentals, you will ultimately enter into a separate rental agreement with the third-party car rental company that supplies the vehicle. Hola Car Rentals is not a party to your rental car contract – that contract is solely between you (the renter) and the rental Provider you choose. The rental company’s own terms and conditions (including rental qualifications such as age, driver’s license requirements, insurance, fuel policy, etc.) will apply to your use of the vehicle and you will typically sign or agree to the Provider’s rental agreement at the time of pick-up. It is your responsibility to review and comply with the rental Provider’s agreement and policies.

By facilitating your booking, Hola Car Rentals makes no warranties or representations regarding the rental vehicle or services provided by the third-party Provider. The Provider is solely responsible for delivering the vehicle in proper condition and for all aspects of the rental experience, including but not limited to vehicle maintenance, safety, legality of operation, and service quality. Any questions, concerns, or disputes regarding the actual rental (such as vehicle condition, features, or charges at the rental counter) should be addressed directly with the rental company.

Hola Car Rentals disclaims any liability for incidents or occurrences that take place during your rental period. Because we are not the vehicle owner or operator, we are not responsible for any accidents, injuries, damages, losses, or personal harm you or anyone may suffer during the rental. Likewise, Hola Car Rentals is not liable for any traffic violations, parking tickets, toll infractions, fines, or penalties incurred by you or any driver of the rental vehicle during the rental term. You assume full responsibility for operating the rental car in accordance with the law and the rental agreement. All financial obligations or legal consequences arising from vehicle operation (e.g. fines for speeding or towing charges) rest with the renter and/or the Provider as dictated by the rental agreement and applicable law. In the event of an accident, breakdown, or any issue with the vehicle, you must contact the rental car company and the appropriate authorities or insurers as required by the Provider’s policies; Hola Car Rentals will assist with customer service to the extent possible (e.g. providing contact information), but we are not responsible for resolving such incidents. By using our service, you acknowledge that the rental car company, and not Hola Car Rentals, is solely liable for providing and managing the rental car and related services, and you agree that Hola Car Rentals shall not be held liable for any loss, injury, or damage arising from the rental car or your use of it.

Complimentary Travel Protection Services

Hola Car Rentals may offer or advertise complimentary travel protection services (such as travel insurance or additional liability coverage) as a perk to customers booking through our platform. For example, some reservations may include free travel insurance with medical coverage up to a certain limit or third-party liability insurance coverage on select itineraries. Any such travel protection or insurance benefit is provided by an independent third-party provider (e.g. an insurance company) and not by Hola Car Rentals itself. These protection services are subject to their own terms, conditions, and exclusions as set by the third-party provider.

Disclaimer: Hola Car Rentals does not guarantee or make any assurances about the scope, adequacy, or fulfillment of any third-party travel insurance or protection plan offered through our Site. The inclusion of complimentary coverage does not substitute for personal travel insurance you might obtain on your own, and it does not imply that Hola Car Rentals endorses or assumes responsibility for the third-party provider’s performance. We are not the insurer or administrator of these policies, and we assume no liability for the handling of claims, the payment of benefits, or the coverage decisions made by the third-party insurer. It is your responsibility to review all policy documents and details for any travel protection provided (coverage limits, claim procedures, exclusions, etc.) and to contact the third-party insurance provider directly with any questions or claims. By accepting the complimentary travel protection, you acknowledge that any assistance or coverage is provided by a third party at no additional cost, and Hola Car Rentals shall not be held liable if the protection is insufficient, delayed, or denied in whole or in part. This free service is offered “as-is” with no warranty from Hola Car Rentals regarding its fitness for your needs.

User Obligations and Responsibilities

By using our Site and services, you agree to comply with the following user obligations. These obligations are designed to ensure lawful and proper use of our platform and to facilitate a smooth car rental booking process:

• Legal Capacity and Age: You represent that you are at least 18 years of age (or the age of legal majority in your jurisdiction) and have the legal authority to enter into this agreement and to use our Site in accordance with these Terms. If you book a rental car, you further confirm that you meet the minimum age and driver’s license requirements of the rental Provider for the destination in question (note: many Providers require drivers to be 21 or older, and additional fees or conditions may apply for drivers under 25). You are financially responsible for all uses of our Site by you and those using your login credentials, including minors under your supervision.

• Truthful and Complete Information: You agree to provide accurate, current, and complete information when using our Site or services, including information needed to make a reservation (such as your name, contact details, driver’s information, and payment details). You are responsible for verifying that all details of your booking request are correct. If you have an account, you agree to keep your account information updated. Misrepresenting your identity, age, qualification to rent, or any other important information is a breach of these Terms.

• Legitimate Use Only (No Fraudulent Bookings): You may only use this Site to make legitimate, bona fide reservations or purchases for yourself or for another person on whose behalf you are legally authorized to act. Any speculative, false, or fraudulent reservation, or any reservation made with the intent to resell or in anticipation of demand, is prohibited. You agree not to use the booking facilities to hold or block speculative rentals or to make false reservations for any purpose. Hola Car Rentals may cancel, without notice, any reservation we reasonably suspect to have been made in violation of this rule.

• Compliance with Provider Terms and Law: You agree to abide by all terms and conditions of the rental car Provider that apply to your reservation, as well as all applicable laws and regulations when driving the rental vehicle. This includes (but is not limited to) observing all traffic laws, possessing a valid driver’s license, carrying required insurance or documentation, and not using the vehicle for illegal or prohibited purposes (such as off-road driving when not allowed, or in a ridesharing capacity if forbidden by the rental agreement). You are responsible for any penalties, fines, or consequences of unlawful conduct or violation of the rental agreement during your rental.

Failure to comply with the rental company’s requirements or the law may result in consequences such as the Provider refusing to release the vehicle, termination of your rental, additional fees, or legal liability. Hola Car Rentals is not responsible if your failure to meet these obligations results in a canceled reservation or inability to use the rental.

• Prohibited Activities on the Site: You agree not to misuse the Hola Car Rentals Site. Prohibited activities include, but are not limited to: interfering with the operation of the Site or its security; attempting to gain unauthorized access to any system or data; using any automated means (like bots or scrapers) to extract data; and engaging in any activity that imposes an unreasonable burden on our infrastructure. You also agree not to use the Site or its content for any commercial purpose outside the scope of personal car rental reservations, and not to make any use of the Site that is unlawful or violates these Terms.

• Account Security: If you create an account on our Site, you are responsible for maintaining the confidentiality of your login information. You agree to notify us immediately of any unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

By fulfilling these user obligations, you help ensure that the Hola Car Rentals platform remains reliable and secure for all users. If you violate these Terms or engage in improper use of the Site, we reserve the right to terminate your access and/or cancel your bookings (with or without notice) in our sole discretion, and you may also expose yourself to legal liability.

Intellectual Property Rights

All content and materials on the Hola Car Rentals Site – including text, software, code, scripts, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, page layout, design, and other material – are the intellectual property of Hola Car Rentals (Andaluz Group LLC) or its content suppliers and partners, and are protected by United States and international copyright, trademark, and other intellectual property laws. This includes content provided by third-party Providers such as rental car companies, which is used on our Site by license or permission. The compilation of all content on the Site is the exclusive property of Hola Car Rentals.

Hola Car Rentals™ and associated logos, designs, and slogans are trademarks/service marks of Andaluz Group LLC. All other trademarks, product names, or company names that appear on the Site (for example, the names or logos of rental car companies) are the property of their respective owners. Their appearance on our Site does not imply endorsement or affiliation with Hola Car Rentals and remains subject to the
ownership rights of those third parties.

We grant you a limited, revocable, non-exclusive, personal license to access and make use of the Site for the sole purpose of researching and booking car rentals for yourself or others under your authority. No other use of the Site or its content is allowed. You may not reproduce, distribute, modify, transmit, perform, publish, license, create derivative works from, or sell any content, information, software, or services obtained from this Site without express prior written consent from Hola Car Rentals. Any unauthorized use or exploitation of our content or intellectual property is strictly prohibited and may result in termination of the license granted to you, cancellation of your bookings, and legal action. As a condition of using the Site, you expressly agree not to use the Site or its contents for any commercial or unlawful purpose beyond the scope of these Terms.

If you submit feedback, comments, or suggestions about our Site or services, you agree that we may use and share such feedback for any purpose without compensating you. All rights not expressly granted to you in these Terms are reserved by Hola Car Rentals and its licensors.

Disclaimer of Warranties

Hola Car Rentals provides the Site and all services “as is” and “as available,” without any warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site and any service or content obtained through it. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties that may arise from course of dealing or course of performance. We do not guarantee that the Site will be available on an uninterrupted, timely, secure, or error-free basis, or that it will meet your requirements or expectations.

Use of Third-Party Information: Much of the information on our Site (including car availability, descriptions, amenities, prices, and insurance offerings) is provided by third-party Providers. Hola Car Rentals does not warrant or confirm that any such information is accurate, complete, current, or free of errors or misrepresentations. The inclusion of any car rental offer on our Site does not constitute any endorsement or warranty by Hola Car Rentals of the quality or safety of that rental service. We will use reasonable efforts to keep information up-to-date and to correct any errors we become aware of, but we cannot guarantee the correctness or completeness of Provider-supplied data (such as a rental car’s features or availability). Images of rental cars on the Site are for illustrative purposes only – the actual vehicle make/model or specifications may vary (within the “or similar” class, as defined by the Provider).

No Guarantee of Service Outcomes: Hola Car Rentals makes no guarantee that a rental car booking will always result in a successful rental or that the Provider will honor the reservation in every instance. While we strive to ensure confirmed reservations, final fulfillment is outside our control and the responsibility lies with the Provider. Additionally, Hola Car Rentals is not responsible for any technical failures or events beyond our control that may affect your access to the Site or the processing of your reservation (including network outages, system errors, malicious attacks, natural events, or Provider system failures). We do not warrant that any emails or communications from us or our Site will be free of viruses or other harmful components.

You assume all risk for any use of the Site and services. Any material or information obtained through the Site is used at your own discretion and risk. It is your responsibility to ensure that any products, services, or information available through the Site meet your specific needs. If you are dissatisfied with the Site or any of our services, your sole remedy is to stop using them. No advice or information (oral or written) obtained from Hola Car Rentals or through the Site shall create any warranty not expressly stated in these Terms. Some jurisdictions do not allow the exclusion of certain warranties, so the above disclaimers may not fully apply to you. In such jurisdictions, the scope and duration of any implied warranty will be the minimum permitted under applicable law.

Limitation of Liability

To the maximum extent permitted by law, in no event shall Hola Car Rentals (Andaluz Group LLC), its parent, affiliates, or any of their respective officers, directors, employees, agents, or partners (collectively, “Covered Parties”) be liable for any special, indirect, incidental, consequential, exemplary, or punitive damages whatsoever. This limitation of liability applies regardless of the form of action, whether in contract, tort (including negligence), strict liability, or any other legal theory. Covered damages include, for example, any loss of profits, loss of business, loss of data, loss of goodwill, cost of substitute services, or any other intangible losses arising out of or in connection with your use of (or inability to use) the Site or any services obtained through the Site. The Covered Parties shall not be liable for any delay or failure in performance beyond our control, or for any content errors, omissions, or inaccuracies on the Site. Additionally, no Covered Party shall be responsible or liable for the acts or omissions of any third-party Providers, and you specifically agree that Hola Car Rentals is not liable for any injury, damage, or loss caused by the rental car company or arising from your use of a rental vehicle booked through our platform. This exclusion of liability includes any claims for personal injury or property damage, which are matters solely between you and the third-party Provider or insurer.

If, notwithstanding the above disclaimers, a Covered Party is found liable to you for any claim arising out of or related to the Site or any service, the maximum aggregate liability we will owe you (to the extent permitted by law) is the total amount of fees you paid to Hola Car Rentals for the reservation or service in question. For example, if your booking on our Site included a service fee paid to us, our liability for any issue with that booking will not exceed the amount of that fee. If you paid us no direct fees (for instance, if we received commission from the Provider), our liability will be limited to a nominal sum as required by law. This limitation of liability reflects the allocation of risk between you and us as part of this agreement.

Exceptions: Some states or jurisdictions do not allow the exclusion or limitation of liability for certain damages (such as incidental or consequential damages), so portions of the above limitation may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law. Nothing in these Terms is intended to exclude or limit any condition, warranty, right or liability which may not be lawfully excluded or limited under applicable law (for example, certain statutory rights which apply to you if you are using our services as a consumer).

You acknowledge that the limitations of liability above are a fundamental basis of the bargain and a condition of us allowing you to use our Site and services, and that Hola Car Rentals would not be able to offer its services on an economically feasible basis without such limitations.

Indemnification

You agree to indemnify, defend, and hold harmless Hola Car Rentals (Andaluz Group LLC), its owners, affiliates, and their respective officers, directors, employees, agents, and representatives (the “Indemnified Parties”) from and against any and all claims, causes of action, demands, losses, liabilities, damages, judgments, settlements, fines, penalties, costs, or expenses of any kind (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or services; (b) your breach of these Terms or of any other agreement or policy incorporated by reference; (c) your violation of any law or regulation or the rights of any third party; or (d) any transaction or dispute between you and a thirdparty Provider or other third party (including, without limitation, any claims relating to accidents, injuries, property damage, or traffic violations during a rental) 18. This indemnification obligation applies whether the third-party claim arises from the actions of you or someone using your account (with or without your permission).

Hola Car Rentals reserves the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In that case, you agree to cooperate with our defense of such claim and you may not settle any such matter without our prior written consent. You agree to promptly notify us of any third-party claims by sending an email to our customer support or legal team.
Your indemnification obligation will survive any termination of these Terms or your use of the Site, to the fullest extent permitted by law.

Governing Law and Jurisdiction

Governing Law: These Terms and Conditions and any dispute arising out of or relating to the use of our Site or services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. This governing law applies even if you are accessing the Site from outside the United States. You acknowledge that these Terms are considered a legally binding contract under law, and the choice of Delaware law is a material term of this agreement.

Jurisdiction and Venue: You agree that any legal action or proceeding arising under or relating to these Terms, the Site, or the services must be brought exclusively in the state or federal courts located in the State of Delaware. You consent to the personal jurisdiction of such courts and waive any objection on grounds of inconvenient forum or any similar doctrine. Specifically, you agree to submit to the jurisdiction of the courts in Delaware (and if necessary, the United States District Court covering Delaware) for the resolution of all disputes. Nothing in this section prevents Hola Car Rentals from seeking injunctive relief or any other available legal remedy in any competent jurisdiction to protect its intellectual property or confidential information.

If you are accessing the Site from a location outside the U.S., you remain responsible for complying with all local laws. However, the governing law for the contract between you and Hola Car Rentals is Delaware law. In the event of any dispute about these Terms or the services, the prevailing party will be entitled to recover its reasonable attorneys’ fees and costs, in addition to any other relief granted.

Changes to Terms and Conditions

Hola Car Rentals reserves the right to modify or update these Terms and Conditions at any time. If we make changes, we will post the revised Terms on this page and update the “Last Updated” date at the top (or provide a notice on our homepage or via email if the changes are material). All changes are effective immediately when posted unless a later effective date is specified. It is your responsibility to review these Terms periodically for updates. Your continued use of the Site after any changes are posted constitutes your acceptance of those changes and the updated Terms. If you do not agree to a modification, you must stop using the Site and services. 

No alteration of these Terms by you is valid unless expressly agreed in writing by an authorized representative of Hola Car Rentals. From time to time, Hola Car Rentals may also offer specific features or promotional services which are subject to additional or different terms and conditions; in the event of a conflict between those additional terms and these Terms, the additional terms for the specific feature will prevail for that feature.

Miscellaneous Provisions

Entire Agreement: These Terms and Conditions, along with our Privacy Policy and any additional terms incorporated herein or provided in connection with particular services or promotions, constitute the entire agreement between you and Hola Car Rentals regarding your use of our Site and services. They supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Hola Car Rentals with respect to the Site or services.

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed by us in writing.

No Waiver: No waiver by Hola Car Rentals of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Hola Car Rentals to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer any of your rights or obligations under these Terms without prior written consent from Hola Car Rentals. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law or otherwise. These Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

Headings: The section headings in these Terms are for convenience only and have no legal or contractualeffect.
